TERMS AND CONDITIONS

INTRODUCTION

1. Jason Herbers Insurance Agency (“the Company”) is located at 7440-H.S. Woodward Ave, Woodridge, IL 60517.

RAFFLE

2. By submitting your raffle draw application, you hereby confirm that all the information you submit are yours, or you are the authorized person to submit on behalf the aforementioned name in the application.
3. You know that your application was successfully submitted for the raffle draw once you see the submission success page after submitting your application.
4. The Company has the right to use the data you have entered in your application for any commercial or promotional activities it conducts.
5. The Company’s raffles and/or give-away winner are chosen randomly.
6. At the absolute discretion of the Company, the Company shall determine the item for give away or raffle. Any items raffled or given away shall be final.
7. Raffle draws are conducted by the Company and are not subject for negotiations or arguments.

WINNER

8. Any winner of the raffle draw application or giveaway shall not be in any way construed as a representative of the Company.

REFERRALS

9. You shall be held responsible and liable for any and all referrals suggested by you to the Company.
10. By suggesting referrals to the Company, you hereby consent and authorize the Company to contact and collect the personal information of the respective referral(s) for the purpose of contacting them, such contact shall include for the purpose of without limitation, insurance.
11. In the event that you fail to participate and/or attend a concern or event as per the winning tickets / voucher, the Company are not obligated in any way whatsosever to provide an alternative date for any reason whatsoever.
12. Any products, merchandise, tickets, and/or any other raffled item(s) are given away on ‘as is’ basis.

BEING A CUSTOMER OF THE COMPANY     

13. It is not a requirement to become a customer of the Company to be eligible for the raffle and free give away (as the case may be).

DISCLAIMER OF WARRANTIES

14. You agree that by participating in the Raffle is at your sole risk. All information and content are provided on an “as is” and “as available” basis.

• The Company, its affiliates, agents and licensors cannot and do not warrant the accuracy, completeness, correctness, non-infringement, merchantability, or fitness for a particular purpose.
• The Company does not guarantee the raffle to be error-free, secure, continuously available or free of viruses or other harmful components.
• You also agree that if you rely on any data or information obtained, you do so at your own risk. You are solely responsible for any damage or loss that results from your use of any material and/or data.
• The Company its affiliates, agents, and licensors make no warranty.

LIMITATION OF LIABILITY

15. Under no circumstances will the Company or its affiliates, agents or licensors be liable to you or anyone else for including but not limited to any loss and/or damages, including, without limitation, liability for consequential, special, incidental, indirect, or similar damages, even if we are advised beforehand of the possibility of such damages.
16. Without prejudice to Clause 13 herein, nothing in this disclaimer will :-

• limit or exclude any liability for death or personal injury resulting from negligence;
• limit or exclude any liability for fraud or fraudulent misrepresentation;
• limit any liabilities in any way that is not permitted under applicable law; or exclude any liability that may not be excluded under applicable law.
